SimicChameleon – Freelance Artist Terms of Service (TOS)

By commissioning me, you agree to the terms listed below. Please read carefully before proceeding with a commission.

Payment

Accepted Payments: PayPal or Amazon Gift Cards only.

Payment Terms:

Payment is upfront. I do not accept payments after the work is done.

Online invoices only. Cryptocurrency and eChecks are not accepted.

Small commissions (e.g. icons) must be paid within 24 hours, or they will be canceled.

Larger projects may have partial payment options and extended deadlines depending on complexity.

Late Payments:

You will receive one reminder. If not paid promptly, your commission is canceled.

I will not chase after clients for payment.

Turnaround Time & Work Schedule

Artwork may take 1 day to 1 month depending on complexity.

I work Monday to Friday only.

Updates are issued every Thursday or Friday.

Commissions are tackled based on type and complexity, not in the order received.

Revisions & WIPs

3 revisions maximum allowed.

A sketch WIP will always be provided before finalization.

Sketches do not reflect the final product.

Work will not continue until the sketch is approved.

No revisions are allowed after the final work is complete, including weeks, months, or years later.

Communication

I operate best with prompt communication.

It is the client’s responsibility to respond to WIPs and feedback requests in a timely manner.

I do not respond outside work hours or during downtime.

Abusive, rude, or creepy behavior will result in immediate cancellation.

Usage & Rights

Reposting is allowed, but you must credit me as "SimicChameleon".

You may not:

Mint or sell my work as NFTs.

Use my work in AI datasets or generators.

Violation of these rules will result in a permanent blacklist.

I retain the right to use select commission pieces for promotional purposes.

You retain full rights to your commissioned artwork otherwise.

Commission Requirements

You must be 18+ years of age to commission me.

I require:

Full and accurate details of your commission idea.

At least one visual reference and a color palette.

I can work with:

Creative freedom or limited direction.

I do not work well with full text-only descriptions.

Cancellations & Refunds

I reserve the right to cancel a commission at any time before starting, with a full refund.

If you cancel after work has begun, you will receive a partial refund based on progress.

All completed files will be delivered in this case.

No refunds after the final work is completed.

Illegitimate refund requests (e.g. financial regret, choosing another artist) will result in a ban.

Chargebacks will result in:

Permanent blacklist.

Possible public warning depending on severity.

Me taking every possible action to dispute.

Blacklist Policy

You will be permanently blacklisted for:

Rude, abusive, or creepy behavior

Illegitimate refund requests

Art Style & Preferences

Do not ask me to change my art style unless I’m offering a style-specific commission.

I may decline commissions not within my strengths or ask for adjustments.

I do not accept all commission offers.

Lack of Accountability:

2. Not taking responsibility for one's actions results in a loss of respect and trust.

Insensitive Humor:

3. Making jokes about sensitive topics like suicide, self-harm, and rape is unacceptable.

Flakiness:

4. Flaky individuals are considered a waste of time due to their unreliability.

5. Art Theft:

Artists who steal original characters (OCs) are engaging in unethical behavior.

6. Overreliance:

People who overly depend on you for emotional support, treating you like a therapist, while disregarding your advice can strain relationships.

7. Disrespecting Boundaries:

Violating personal boundaries or personal space is a clear red flag.

Inappropriate Behavior:

8. People being lecherous or overly lustful towards artists, disrespecting their personal lives beyond the online realm.

9. Entitlement and Requests:

Requesting free art without putting in work attracts entitled individuals. Refusing art requests helps avoid egocentric behavior.

10. Public Pity Parties:

Venting excessively online can lead to negative consequences, resembling a pattern seen in certain individuals over time.
